SUBJECT: Response to the Memo-pamphlet of the KORECT d.o.o. No.04/007, dated 13 October 2020
Dear Sirs/Madams,
On 16 October 2020, we received by mail a memo – pamphlet from the director and owner of the company Korekt d.o.o. Sarajevo, Mr. Bojan Bajic, No.04/007 dated 13 October 2020, titled “Analysis of Sarajevo Tower Construction Interruption”.
Relation to the said, ANS Drive d.o.o. Sarajevo wished to emphasise the following:
1.According to the available data from the court register, the company KOREKT d.o.o. Sarajevo, was established on 16 September 2020, i.e. less than a month before sending the titled memo-pamphlet.
2.According to the publicly available information, the director and owner of the KOREKT d.o.o. Sarajevo is Mr. Bojan Bajic, who is a signatory of the said memo-pamphlet; he is not on any of the lists of court experts in any of the fields being the subject of the said memo-pamphlet (construction and finances), nor is he on any of the lists of any court experts in any field.
3.According to the publicly available information, the very company KOREKT d.o.o. Sarajevo is not on any list of companies authorised for the work of expert evaluation in any of the fields being the subject of the said memo-pamphlet (construction and finances), nor is it on any of the lists of companies authorized for expert evaluation in any field.
4.According to the data available to ANS Drive d.o.o. Sarajevo, the signatory of the said memo-pamphlet, Mr. Bojan Bajic does not have higher education in any of the fields being the subject of the said memo-pamphlet (construction and finances).
5.According to the date available to ANS Drive d.o.o. Sarajevo, the signatory of the said memo-pamphlet, Mr Bojan Bajic does not have higher education in any other filed either, i.e. according to the date available to ANS Drive d.o.o. Sarajevo, Mr. Bojan Bajic is a person with secondary level of education.
6.According to the date available to ANS Drive d.o.o. Sarajevo, the signatory of the said memo –pamphlet, Mr. Bojan Bajic is not an authorised official of an execution body, and therefore cannot possess and does not possess all relevant documentation and evidences available to the execution bodies in relation to the criminal procedure he is commenting.
7.Bojan Bajic, and so he himself claims in his memo-pamphlet, has been engaged by the company Smart Invest d.o.o. Sarajevo, whose director Mr. Elvedin Mahmutovic, is accused party in a criminal procedure against him before the Municipal Court in Sarajevo.
8.Due to the above reasons, ANS Drive d.o.o. Sarajevo, notes that the subjected memo-pamphlet, although put together rather readably and “easy”, as if it would be published in a news feuilleton for “wide masses”, has no relation to writing documents and analysis in line with relevant scientific methodologies, nor with a numerous rules of construction and financial profession. It rather contains a number of thesis, hypothesis and constructions with the sole goal to assist the thesis of defending the accused director of Smart Invest d.o.o., Sarajevo, Mr. Elvedin Mahmutovic.
9.The fact is that the Director of ANS Drive d.o.o. Sarajevo testified before the Municipal Court in Sarajevo in criminal procedure against the accused Director of Smart Invest d.o.o. Sarajevo, Mr. Elvedin Mahmutovic, and that he submitted the complete documentation related to the issues dealt by in the commissioned Mr. Bojan Bajic’ s
10.It is also the fact is that the Director of ANS Drive d.o.o. Sarajevo, as well as ANS Drive d.o.o. Sarajevo as a whole, will continue cooperating with the responsible bodies and will make all relevant documentation available to them, at their request.
11.The ANS Drive d.o.o. Sarajevo also observes that the subjected pamphlet presents obvious and by the accused persons ordered pressure not only to the Director of ANS Drive d.o.o. Sarajevo, as a key witness in the criminal procedure, but also the legislative bodies, including the pressure by accentuation on submitting criminal procedures by Mr Bojan Bajic against representatives of prosecution bodies acting in the criminal procedure against the persons who ordered the subjected pamphlet.
12.Of everything that the subjected pamphlet is trying to create a false image, including the alleged “turnover in the standpoint of ANS Drive d.o.o. Sarajevo” (towards EUROPROFIL commerce d.o.o. Sarajevo) and alleged “alliance” between ANS Drive d.o.o. Sarajevo and EUROPROFIL commerce d.o.o. Sarajevo, the Director of ANS Drive, Mr. Asmir Dzevlan had already testified before the Court, in the procedure against the Director of Smart Invest d.o.o. Sarajevo, Mr. Elvedin Mahmutovic. He had been interrogated about everything before the Court, where he provided detailed explanations. The main hearing is public (and any interested person can be at it). This is the only legitimate and relevant way to prove evidences in criminal procedure, and Mr. Mahmutovic’s defence will have the chance further in the process to propose and present its evidences, including the subjected pamphlet, if they wish so and deem useful. Still, the said does not have the characteristic of weight of any findings, but it is only a quasi-scientific attempt to deceive all persons involved in the project, prepared by a non-qualified person.
13.Unfortunately, having in mind that the said pamphlet was sent by Smart Invest d.o.o. Sarajevo also to the buyers of flats in the Sarajevo Tower, i.e. it was published on the Facebook page “Stanari Sarajevo Tower” with more than 300 buyers of flats in Sarajevo Tower and that it is used to misinform and pressure responsible prosecution bodies, we are forced, with the aim of proper informing, to prepare a more detailed response to the allegations given in the pamphlet. Due to confidentiality, in the phase, the detailed response will be submitted to the following institutions: Sarajevo Canton and Zenica-Doboj Canton Prosecution Offices, Bosnia and Herzegovina Prosecution Office, Bosnia and Herzegovina State Investigative and Protection Agency – SIPA, Financial-investigation Department, USA Embassy to Bosnia and Herzegovina, FBI Office-FBI Attache, FBiH Financial police and responsible Indirect Taxation and direct taxation authorities in Bosnia And Herzegovina.
The company ANS Drive d.o.o. Sarajevo, requires that the company KOREKT d.o.o. Sarajevo, its Director and owner Mr. Bojan Bajic, as a creator of the said pamphlet, i.e. Smart Invest d.o.o. Sarajevo, as the ordered of the subjected pamphlet, to publish a official denial in relation to all untruth and/or incomplete statements from the pamphlet, which are related to ANS Drive d.o.o. Sarajevo, and especially the untruth and incomplete statements on alleged “turnover” and alleged “alliance” of the ANS Drive d.o.o. Sarajevo on social network pages they used to publish the said untruth, as well as to send the said official denial to institutions they had informed, within the period of three (3) calendar days from the day of receiving this letter.
